Fair Use Policy
At Online Doctor Consult, we are committed to facilitating accessible and convenient healthcare for our Users. The aim of this Fair Use Policy (Policy) is to ensure that the Services provided by Partner Practitioners through the Online Doctor Consult Platform are used responsibly and fairly, while also preventing misuse or abuse of the Online Doctor Consult Platform.
While we have used our best efforts to outline instances of Unacceptable Use (defined below), it is not possible to provide an exhaustive list of all instances of such use. From time to time, Online Doctor Consult may form the opinion that certain conduct constitutes Unacceptable Use and, where we have done so, we will provide reasons for that opinion.
Capitalised terms not defined in this Policy have the same meaning given in the Terms.
What is Acceptable Use?
Before outlining matters that may be considered Unacceptable Use by Online Doctor Consult, we have outlined some key criteria to determine when use is acceptable. Use will generally be acceptable where it is not deemed to be Unacceptable Use, including where a User:
- Provides timely, accurate, complete and truthful information
- Uses the Online Doctor Consult Platform to make legitimate health-related enquiries, consultations and requests
- Respects the time and expertise of Partner Practitioners providing Services through the Online Doctor Consult Platform
What is Unacceptable Use?
Unacceptable Use includes doing, or attempting to do, the following:
- Frequently cancelling requests without valid reasons
- Manipulating or deceiving Partner Practitioners or Online Doctor Consult staff
- Providing false or misleading information during consultations
- Sharing or requesting explicit or inappropriate content on the Online Doctor Consult Platform
- Submitting multiple requests for the same or similar issue, including after being notified that a Partner Practitioner has deemed the issue or request to be “out of scope”
- Allowing others to use your Account, requesting Services on behalf of another person, or pretending to be another person (including by creating multiple accounts)
- Submitting an unusually high number of consultation requests without medical necessity
- Using the Online Doctor Consult Platform for “drug-shopping”, “doctor-shopping”, “outcome shopping”, or similar conduct
- Engaging in inappropriate or abusive behaviour towards Partner Practitioners or Online Doctor Consult staff, including the use of offensive or inappropriate language in any communications
- Using the Online Doctor Consult Platform to engage in or promote illegal or unlawful activities
Where Online Doctor Consult or a Partner Practitioner reasonably believes that a User’s use of the Online Doctor Consult Platform or the Services constitutes Unacceptable Use, Online Doctor Consult may determine that there has been a breach of this Policy.
